1. Scope of validity and definitions
1.1 The term "websites" comprises all websites published by SPAR Business Services GmbH, hereinafter referred to as SPAR ICS.
1.2 These Terms of Use apply to all offers, content, information and goods and services of all types ("Services") provided by SPAR ICS on the accessible websites. By using the Services, you accept these Terms of Use.
1.3 "Users" are all persons who access and use the websites.

SPAR ICS shall be entitled to amend these Terms of Use at any time. Amendments to the Terms of Use shall be published on the websites and shall take immediate effect.
2. Copyright, conduct obligations, infringement of third-party property rights
2.1. Unless otherwise stated, copyright/rights of use in respect of all content posted by SPAR ICS websites (images, illustrations, texts, animations, videos, music, data, etc.) and the materials used for such purpose shall be held exclusively by SPAR ICS or a group affiliate. Use of the content made available on the websites is only permitted for personal information purposes; any modification, duplication, distribution, inclusion, or reproduction of the content on other websites or other media or systems shall require the express prior written consent of SPAR ICS. The use of marks (e.g. trademarks, logos), irrespective of the presence of a symbol ® or ™, is expressly prohibited. In so far as third-party software is accessed via hyperlinks, the rules of the third-party provider shall apply, and the third party's rights must be observed.
2.2. SPAR ICS shall be entitled to block access to the websites if a user violates statutory obligations or obligations established under these Terms of Use.
3. Availability and liability
3.1. In order to be able to use the content of the websites in full, SPAR ICS recommends use of the latest (browser) technologies and the enabling of such use (e.g. activation of JavaScript). When using older technologies, it may be the case that the user only has limited use of website content.
3.2. SPAR ICS shall be liable for neither content, information or programs distributed on the websites, nor for any losses thereby arising, unless such losses shall have been occasioned by SPAR ICS intentionally or through gross negligence. This shall apply with regard to all types of losses, including losses which may arise due to errors, delays or interruptions in transmission, in the event of malfunctions of technical facilities and services, incorrect or missing content, loss or deletion of data, viruses or in any other manner in the context of use of this online provision.
3.3. SPAR ICS has made every reasonable effort in order to ensure that the information which it has posted on this website is correct and complete at the time of posting. SPAR ICS assumes no warranty as regards the content, accuracy, lawfulness and functionality of third-party websites accessed by means of links such as hyperlinks or other content, placed either directly or indirectly on the websites. Page views via links are always at the user's own risk.

5. General
5.1. Access to and use of the websites is subject to Austrian law. All disputes between a user and SPAR ICS which cannot be resolved out of court shall be decided exclusively by the court having subject-matter competence in the regional state capital of Salzburg.
5.2. If the user is a consumer within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG), and if the user has their domicile or habitual residence in Austria, or works in Austria, then with regard to any legal proceedings against the user, the competent court shall be the court for the district in which the user has their domicile, habitual residence or place of work (Section 14 of the Austrian Consumer Protection Act).
5.3. In the event that any individual provisions of these Terms of Use should be or become invalid, this shall not affect the validity of the remaining terms hereof.
